Statutory Rights

None of the information below affects your statutory rights. We are a UK based company and all contracts for the sale of goods entered into by On Point Appliances on the website will be subject to the laws of England and Wales.

How the contract is formed between you and us

Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

After you place an order, you will receive an e-mail from us acknowledging that we have received your order.  However, please note that this does not mean that your order has been accepted.

We will confirm our acceptance to you by sending you an e-mail that confirms that the products have been dispatched or, in the case of Click and Collect, are ready for collection from your nominated store (Dispatch Confirmation).  The Contract between us will only be formed when we send you this Confirmation.

If we are unable to supply you with a product, for example because that product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our site as referred to in clause we will inform you of this by phone or by e-mail and we will not process your order. If you have already paid for the products, we will refund you the full amount including any delivery costs charged as soon as possible.

Right to cancel this agreement

Under the Consumer Contracts regulations 2013, you have the right to cancel your agreement with On Point Appliances within a period of 30 calendar days. This period begins the day after you receive the goods. Please contact us as soon as possible to notify us of your cancellation request. If your order has already been dispatched then you will need to either refuse delivery or return the goods. Refunds will usually be processed within 3-5 days of receipt of the product. Goods must be returned before a refund will be processed and the product must be returned in its original condition.

How you can cancel this agreement

Please contact us as soon as possible if you wish to cancel your agreement, you can do so by writing to us, calling 02392 219 433, or send us a message via info@onpointappliances.com. Orders can only be cancelled before processing or despatch has begun.

Once your order has been successfully cancelled and agreed by On Point Appliances, any sum debited from your payment card by us will be re-credited to your account as soon as possible. If cancelled orders are erroneously delivered to you, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

How On Point Appliances can cancel this agreement

We reserve the right to cancel the order if:-

  • We have insufficient stock to fulfil your order and an alternative is not suitable
  • We are unable to obtain payment
  • We do not deliver to your area
  • A product fault or an error in the product description has been identified

Our right to vary these Terms.

Every time you order Products from us, the Terms in force at the time of your order will apply to the Contract between you and us.

We may revise these Terms as they apply to your order from time to time to reflect any changes in relevant laws and regulatory requirements.

If we have to revise these Terms as they apply to your order, we will contact you to give you reasonable advance notice of the changes and let you know how to cancel the Contract if you are not happy with the changes. You may cancel either in respect of all the affected Products or just the Products you have yet to receive. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will arrange a full refund of the price you have paid, including any delivery charges.

Returns

We want you to be happy with your purchase. If you wish to return goods, then you can do so to our store or by contacting us on info@onpointappliances.com.

Unwanted items should be in new condition, with the original packaging, labelling and with a On Point Appliances receipt. A refund request will usually be actioned within 3 working days from receipt. Please note, for unwanted items, you are responsible for paying all return postage charges.

If you are returning goods that are faulty or incorrect, then any return postage charges you pay will be refunded to you by Marine Super Store.

Delivery & Dispatch

Estimated delivery on a standard service is 3-7 working days after the date of confirmed order, a member of staff will contact you to arrange delivery or installation, dependant on your chosen shipping preference. Occasionally our delivery to you may be affected by an Event Outside Our Control.

Delivery of an Order shall be completed when we deliver the Products to the address you gave us or you collect them from us, or a nominated third party, and the Products will be your responsibility from that time.

Click & Collect

You can elect to have your collect your order from our shop location.

On choosing the Click and Collect service you will receive an email from us confirming that you have opted to collect your product(s) via the Click and Collect Service.

You will subsequently receive a phone call confirming when the products have arrived at your chosen Click and Collect point and are ready for collection.

Products will be held for a period of no more than 30 days, after which the contract will be considered cancelled and you will be refunded.

To collect the products you will need to bring with you the Order Confirmation in either electronic or printed form and a form of photographic ID (for example, a driving licence or passport).

Product Display

We have made every effort to display the products featured as accurately as possible. However, the colours we use, as well as the display and colour capabilities of your particular computer monitor, may greatly affect the colours you actually see on the screen. On Point Appliances cannot be held responsible for any limitations of your monitor and cannot guarantee that your monitor’s display of any colour, texture, or detail of merchandise will be accurate / the same as the actual product.

Product Pricing

In the very rare event of a product price discrepancy, the purchase price of the product on the On Point Appliances website prevails over the price that may appear on the delivery or product packaging. You will always be charged the price that is displayed on the checkout page.

We try to ensure that all pricing on the website is accurate, but occasionally an error may occur and goods may be incorrectly priced. If we discover that a pricing error has been made, we reserve the right to suspend your order and contact you to ask whether you wish to continue with the order at the correct price. We are not obliged to supply goods at the incorrect price.

Website Errors

We endeavour to present the most recent, most accurate and most reliable information on our website at all times. However, there may be occasions when some of the information featured may contain incomplete data, typographical errors or inaccuracies. Any errors are wholly unintentional and we apologise if erroneous information is reflected in merchandise price or item availability. We present our content ‘as is’ and make no claims to its accuracy, either expressed or implied. We reserve the right to amend errors or to update product information at any time without prior notice.

Website Access

Given the unpredictability of technology and the online environment, On Point Appliances does not warrant that the function or operation of this website will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available will be free of viruses or other harmful elements. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction. As a visitor to, and user of this website, you must assume full responsibility for any costs associated with the servicing of equipment employed in connection with your use of our site. In effect, you agree that your access will be subject to these terms and conditions and that such access is undertaken at your own risk. On Point Appliances shall not be liable for damages or losses of any kind which you may incur from your use of or inability to access this site.

Third Party Links

To provide a greater range of goods, we may provide links to other websites or resources for you to access if you so wish. You acknowledge and agree that, as you have chosen to click on the link, On Point Appliances is not liable in respect of the use of these websites or resources.

Your Account

If you use the website, it is your responsibility to ensure the confidentiality of your account and password and that no unauthorised persons have access to them. You agree to accept responsibility for all activities that occur under your account or password. You should let us know immediately if you believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

Please ensure that your personal details are up-to-date and inform us immediately of any changes to the information that you provided when registering.

On Point Appliances reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, you will not be charged.

Events outside our control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

Complaints

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise: please contact us if you have any complaints or comments.

Governing Law & Jurisdiction

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English courts.
